Welcome to resilience-psychiatry.com (the “Site”), operated by Resilience Psychiatry, P.C. (“Resilience Psychiatry “, “we,” “us,” or “our”). By accessing or using the Site, you agree to these Terms of Use (the “Terms”). If you do not agree, please do not use the Site.
1. Acceptance of Terms of Use:
Use of this Site assumes that you fully accept and agree to the Terms of Use and all other operating rules, policies and procedures set forth in this document or that may be published from time to time on the Site by us, each of which are incorporated by reference. These Terms of Use also state that by submitting your personal information, you are certifying you have read, understand and agree to our Terms of Use as well as our Privacy Policy. Our Privacy Policy can be accessed and reviewed here; Privacy Policy | Resilience Psychiatry and which is incorporated herein by reference. Again, if you do not agree to any of these terms, then please do not use the Site.
2. Informational Purposes Only
All content on the Site — including text, articles, blog posts, condition pages, service descriptions, and provider biographies — is provided for general informational and educational purposes only. It is not medical advice. It is not a substitute for evaluation, diagnosis, or treatment by a licensed mental health professional. Always seek the advice of a qualified healthcare provider with questions about your or your child’s mental health.
3. Participation at Your Own Risk:
By using the Site and any of our other interactive services, you agree that you will solely assume all risk associated with any actions you take in response to, or under the advice of, the Content and Comments made available through the Site.
Although the Site enables users to connect and share Content and Comments with one another, we have no responsibility to control or monitor any information or exchanges between or among users. We do not control the reviews, advertisements and Content and Comments made available on the Site. Some people may find the reviews, advertisements and Content and Comments objectionable, inappropriate or offensive. We do not control or guarantee, nor are we responsible for, the truth, accuracy, ownership, completeness, integrity, safety, timeliness, quality, appropriateness, legality or applicability of any reviews, advertisements, Content and Comments. We assume no responsibility for monitoring any reviews, advertisements, Content and Comments or conduct during use of the Site. We are also under no obligation to modify or remove any reviews, advertisements, Content and Comments and assume no responsibility for a user’s conduct during his or her use of the Site. You agree that we have no responsibility or liability for the deletion or failure to store, maintain or transmit any reviews, advertisements, Content and Comments.
4. No Doctor–Patient Relationship
Visiting the Site, contacting us through a form, or reading content here does not create a doctor–patient relationship between you and Resilience Psychiatry or any of its providers. A clinical relationship begins only after a formal intake, an evaluation appointment, and the execution of the practice’s standard new-patient paperwork.
5. Emergency Notice
If you or someone you are with is in immediate danger or experiencing a psychiatric emergency, do not use this Site to seek help. Instead:
- Call 911.
- Go to the nearest hospital emergency department.
- Call or text 988 (the Suicide and Crisis Lifeline) — free, confidential, available 24 hours a day.
- In Suffolk County, NY, call the Response Crisis Hotline at (631) 751-7500.
Resilience Psychiatry does not monitor the Site, the contact form, email, or voicemail in real time and cannot respond to emergencies through these channels.
6. Telepsychiatry — Licensure Limitations
Our providers are licensed to practice in New York and Florida. Telepsychiatry services are available only to patients who are physically located in New York or Florida at the time of the appointment, in accordance with state licensure laws. Submitting a contact form or scheduling request from another state does not establish eligibility for care.
6. Permitted Use of the Site
You may use the Site for personal, non-commercial purposes consistent with these Terms. You agree not to:
- Use the Site in any way that violates any applicable federal, state, or local law.
- Attempt to interfere with the Site’s operation, security, or availability.
- Scrape, copy, or republish substantial portions of the Site without our written permission.
- Impersonate any person or misrepresent your affiliation with any person or entity.
- Upload or transmit any malicious code, virus, or other harmful material.
7. Intellectual Property
All content on the Site — including text, graphics, logos, images, video, and the overall design — is owned by Resilience Psychiatry, P.C. or its licensors and is protected by United States and international copyright, trademark, and other intellectual-property laws. Except for personal, non-commercial viewing, you may not reproduce, distribute, modify, publicly display, or create derivative works from the Site without our prior written consent.
9. Third-Party Links and Services
The Site contains links to third-party websites and services, including Zocdoc, professional directories, the National Suicide and Crisis Lifeline, and social media platforms. We provide these links for your convenience. We do not control these third-party sites, do not endorse their content, and are not responsible for their availability, accuracy, or practices. Your use of any third-party site is subject to that site’s own terms and privacy policy.
10. User Submissions
We welcome questions and feedback. However, please do not send confidential, sensitive, or protected health information through the Site’s contact form or by ordinary email. Communications you send through the Site are not encrypted and should not be considered private. By submitting any non-confidential question, suggestion, or comment, you grant us a non-exclusive, royalty-free license to use it for the purpose of operating and improving the Site and our practice.
In addition:
A. Resilience Psychiatry shall not own any right, title and interest to your Content and Comments (as defined below). The Information is provided to you “AS IS” for your information and personal use only and may not be used, copied, reproduced, distributed, transmitted, broadcast, displayed, sold, licensed, or otherwise exploited for any other purposes whatsoever. We reserve all rights not expressly granted in and to the Site.
B. Notwithstanding the foregoing, you acknowledge that by submitting, posting or creating Content or Comments through the Site, you automatically grant to Resilience Psychiatry a worldwide, non-exclusive, royalty-free, fully paid, sublicensable and transferable license to use, edit, modify, reproduce, distribute, prepare derivative works of, display, perform, and otherwise fully exploit the Content and Comments in connection with the Site and our (and our successors’ and assigns’) businesses, including without limitation for promoting and redistributing part or all of the Site (and derivative works thereof) in any media formats and through any media channels (including, without limitation, third party websites and feeds). You also hereby do and shall grant each user of the Site a non-exclusive license to access your Content and Comments through the Site, and to use, edit, modify, reproduce, distribute, prepare derivative works of, display and perform such Content and Comments. For clarity, the foregoing license grants to us and our users does not affect your other ownership or license rights in your Content or Comments, including the right to grant additional licenses to your Content or Comments, unless otherwise agreed in writing. You represent and warrant that you have all rights to grant such licenses to us without infringement or violation of any third party rights, including without limitation, any privacy rights, publicity rights, copyrights, contract rights, or any other intellectual property or proprietary rights.
C. If you register, all content added, created, uploaded, submitted, distributed, or posted to the Site by you, whether publicly posted or privately transmitted, is the sole responsibility of the person who originated such content (“Content”). In addition to Content, if you register, you may communicate with us and other users, post or publish comments or rating features, as may be made available at our complete discretion, a message board, chat area, bulletin board, feedback area, news group, email functionality or other communication feature. All such communications are referred to after this as (“Comments”).
11. Disclaimer of Warranties
The Site and all content are provided on an “as is” and “as available” basis, without warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, accuracy, completeness, or non-infringement. We do not warrant that the Site will be uninterrupted, error-free, or free of viruses or other harmful components. Furthermore, Resilience Psychiatry expressly disclaims any warranties: (i) regarding the security, accuracy, reliability, timeliness and performance of the Site, the Content or the Comments; (ii) regarding the goods, services, advice, information or links provided by any third parties or users; (iii) that the Site will meet your requirements; or (iv) that the Site will be error-free or that any errors will be corrected. No advice or information, whether oral or written, obtained by you from the Site shall create any warranty not expressly stated in these Terms of Use.
12. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, RESILIENCE PSYCHIATRY, P.C., ITS PROVIDERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF, OR INABILITY TO USE, THE SITE, INCLUDING, BUT NOT LIMITED TO: (I) ANY DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES ARISING OUT OF THE USE OF OR INABILITY TO USE THE SITE, (II) ANY CLAIM ATTRIBUTABLE TO ERRORS, OMISSIONS, OR OTHER INACCURACIES IN THE SITE, (III) UNAUTHORIZED ACCESS TO OR ALTERATION OF YOUR TRANSMISSIONS OR DATA, (IV) STATEMENTS OR CONDUCT OF ANY THIRD PARTY ON THE SITE OR THE SERVICE, OR (V) ANY OTHER MATTER RELATING TO THE SITE OR THE CONTENT, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR AGGREGATE LIABILITY ARISING OUT OF OR RELATED TO THE SITE WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS (US$100). SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES; IN THOSE JURISDICTIONS, OUR LIABILITY IS LIMITED TO THE SMALLEST EXTENT PERMITTED BY LAW.
13. Indemnification
You agree to indemnify, defend and hold harmless Resilience Psychiatry, P.C., its officers, directors, employees and agents, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney’s fees) arising from: (i) your use of and access to the Site; (ii) your violation of any term of these Terms of Use; (iii) your violation of any third party right, including without limitation any copyright, property, or privacy right; or (iv) any claim that one of your Content or Comments caused damage to a third party. This defense and indemnification obligation will survive these Terms of Use and your use of the Site.
14. Governing Law and Venue
These Terms are governed by the laws of the State of New York, without regard to its conflict-of-laws principles. You agree that any dispute arising out of or related to the Site or these Terms will be brought exclusively in the state or federal courts located in Suffolk County, New York, and you consent to the personal jurisdiction of those courts.
15. Changes to These Terms
Resilience Psychiatry reserves the right, in our sole discretion, and at any time, to update and change the “Terms of Use” without notice to you, and such changes will be effective immediately upon posting. Please review the Terms of Use regularly so that you will be apprised of any modifications. Modifications to the Terms of Use will be effective upon posting to the Site. Your use of the Site following any such modification constitutes your agreement to follow and be bound by the Terms of Use as modified. The last date these Terms of Use were revised is set forth below. If you breach any of these Terms of Use, your right to use this Site will terminate automatically. If any modification is not acceptable to you, your only recourse is to cease to use the Site.

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

You affirm that you are either more than 18 years of age, or an emancipated minor, or possess legal parental or guardian consent, and are fully able and competent to enter into the terms, conditions, obligations, affirmations, representations, and warranties set forth in these Terms of Use, and to abide by and comply with these Terms of Use. In any case, you affirm that you are over the age of 18, as the Site is not intended for children under 18. You are solely responsible for ensuring that these Terms of Use are in compliance with all laws, rules and regulations applicable to you and the right to access the Site is revoked where these Terms of Use or use of the Site is prohibited or to the extent offering, sale or provision of the Site conflicts with any applicable law, rule or regulation. Due to the nature of the Internet, we cannot prohibit minors from visiting our Site. However, our Site is not directed toward children under the age of 13, and we do not knowingly collect information from children under the age of 13 through the Site. If you are under 13 years of age, then please do not use the Site—there are lots of other great web sites for you. Speak to your parents about what sites are appropriate for you.
19. Entire Agreement:
These Terms of Use constitute the entire and exclusive understanding and agreement between you and Resilience Psychiatry, P.C. regarding this subject matter, and supersedes any and all prior or contemporaneous agreements or understandings, written and oral, between you and Resilience Psychiatry, P.C. relating to this subject matter. You may be subject to additional terms and conditions that may apply when you use or access certain features of the Site.
20. Miscellaneous:
These Terms of Use, and any rights and licenses granted hereunder, may not be transferred or assigned by you, but may be assigned by Resilience Psychiatry, P.C. without restriction. The failure to require performance of any provision shall not affect our right to require performance at any time thereafter, nor shall a waiver of any breach or default of these Terms of Use constitute a waiver of any subsequent breach or default or a waiver of the provision itself. If any portion of these Terms of Use is found to be unenforceable, such portion will be modified to reflect the parties’ intention and only to the extent necessary to make it enforceable, and the remaining provisions of these Terms of Use will remain in full force and effect. These Terms of Use constitute the entire and exclusive understanding and agreement between you and Resilience Psychiatry, P.C. regarding this subject matter, and supersedes any and all prior or contemporaneous agreements or understandings, written and oral, between you and Resilience Psychiatry, P.C. relating to this subject matter. You may be subject to additional terms and conditions that may apply when you use or access certain features of the Site.
